I should clarify: I was referring to what you get for 'marriage' from the government. They didn't win the right to live together or to have sex, as they already had that. They didn't win the right to adopt children, though that seems to be on the way. The only thing this victory brings is symbolism and tax cuts. |

Inheritence? You can specify what you want to give in your will. Gaining the right to marry doesn't magically open any doors, it just makes it more convenient to inherit should your S/O die without a will, or exclude you from it intentionally. Advance directives legally should give you the first and last things you mention, though I admit hospitals don't always hold to that. But that's being worked on in a much more significant(national) way elsewhere. In the cases you're talking about, marriage is largely being a convenience, so I'll give you that. It's not just a tax cut/symbolic thing, it's a legal convenience. Less paperwork and legal casework for all. Hooray. EDIT: Also, this and the article I linked to opens up the door to a "whacky" sit-com setup where a character claims to be another character's life partner in order to get visitation rights to deliver a message. Misunderstandings and attempts from the hot nurses at being sensitive/caring ensue as the first character tries to hit on a nurse who thinks he's gay. I CALLED IT HERE, FOLKS. EDIT 2: Okay, looking over things, here's a better overview of what marriage entails from federal levels: Joint parental rights of children Joint adoption Status as "next-of-kin" for hospital visits and medical decisions Right to make a decision about the disposal of loved ones remains Immigration and residency for partners from other countries <== I feel sorry for someone who has to face America as a gay foreigner. Crime victims recovery benefits Domestic violence protection orders <== Is this like a restraining order? Judicial protections and immunity <== What does this mean? What does marriage have to do with it? Automatic inheritance in the absence of a will Public safety officers death benefits Spousal veterans benefits Social Security Medicare Joint filing of tax returns Wrongful death benefits for surviving partner and children Bereavement or sick leave to care for partner or children Child support Joint Insurance Plans Tax credits including: Child tax credit, Hope and lifetime learning credits Deferred Compensation for pension and IRAs Estate and gift tax benefits Welfare and public assistance Joint housing for elderly Credit protection Medical care for survivors and dependents of certain veterans Mostly financial/tax benefits (Social Security/MediCare/Crime victim recovery benefits). A number of these benefits (like adoption) are likely not fully extended to the marriages of the homosexual sort, and as such, most anything with the words "child" or "children" on this list do not apply. |

I just remembered something that was posited about this issue: Supposing that the social purpose of marriage is to create children (and raise said children) then homosexual couples would be unfit for marriage on the grounds that they cannot produce children. Of course, this means that you have to decide what you think the purpose of marriage is, and what it would entail for heterosexual couples who choose not to have children. N.B. This isn't my opinion, just something to consider. Also, this isn't to say that homosexual couples are inferior at or incapable of raising children, just that they cannot biologically produce them. |

Considering that this is purely about marriage in the legal sense (gay people have been having marriages for years, just not ones legally acknowledged by the state), I'd say that argument has nothing to do with this. |

A little late, but I wanted to add my opinion. XD I'm glad Prop 8 got overturned - there is no rational reason that I can think of (that is not based on religion which shouldn't be involved in the first place - not everyone gets married in church, fear, "bigotry", etc) that can deny two homosexuals to be legally married. :/ |
